Handwritten affidavit, 20 cm, signed with his mark by Levi Summers and sworn to C.R. Matheny, clerk. 'Levi Summers being sworn saith that he was subpoenaed and did attend four days as a witness in the above case at the September term of the Sangamon circuit court in 1832.' Docketed on verso. Jacob Bale failed to pay Pollard Simmons $80 on an account. Simmons sued Bale in the Justice of the Peace court to recover the debt but the jury found for Bale. Simmons appealed the judgment to the circuit court. The court subpoenaed Lincoln as a witness for Bale. The case was later dismissed.
