"... being sworn saith that he attended as a witness in this case one day at last term and 2 days at this term as a witness for [defendant]." Signed by Thomas E. Edwards.; Jacob Bale failed to pay Pollard Simmons $80 on an account. Simmons sued Bale in the Justice of the Peace court to recover the debt but the jury found for Bale. Simmons appealed the judgment to the circuit court. The court subpoenaed Lincoln as a witness for Bale. The case was later dismissed.
