By a letter from Atty Genl Bates, I learn that Mr Titus of Pa has been appointed Chief Justice of Utah instead of Elmer S. Dundy of Nebraska who I earnestly recommended. But the Atty General says that he will Recommend the appointment of Mr Dundy for Judge in Nebraska as Mr Ketchum of Pa has refused to accept - a better man than Mr Dundy could not be selected in my judgement to fill the place. Mr Dundy has practiced law in this District for 6 years and at this time we have not a judge in the Territory (Judge Lockwood who lives here being temporarily abscent) and for two years we have not averaged much over one judge during the whole time. You will confer a great personal favor on me and give this District an excellent man for judge and one who will always be at his post by the appointment of Elmer S. Dundy—Most Respectfully your obdnt servant
