Writ of Fieri Facias in James P. Hawthorn vs. David Wooldridge (assumpsit)

Description:
Printed form, 33 cm, filled in and signed by William Butler, clerk, ordering the sheriff of Sangamon County to recover the costs of the suit. Docketed on verso: 'James P. Hawthorn vs David Wooldridge: Fi. Fa,' with costs, 'by cash in full paid Butler August 20th, 1837.' Wooldridge asked Hawthorn to break twenty acres of prairie sod for which Wooldridge would pay him $50. Wooldridge also asked Hawthorn to break eighteen acres of prairie sod for which Wooldridge would allow Hawthorn to use the land for as long as necessary to raise wheat or corn. Wooldridge failed both to pay him and to allow him to use the land. Hawthorn sued Wooldridge in an action of assumpsit to recover the debt and requested $100 in damages. Wooldridge retained Stuart and Lincoln, pleaded not guilty, and requested a set-off of $314 because Hawthorn failed to pay him when Hawthorn was a tenant. The parties reached an agreement, and the court dismissed the case.
