Witness affidavit from Nelson R. Ashurst

Printed form, 9 x 21 cm, filled in and signed by William Butler, clerk: 'Nelson R. Ashurst being duly sworn, says that he attended four days as a witness in the above cause, on behalf of the plaintiff.' Docketed on verso: 'assumpsit case, Hawthorn vs. Wooldridge.' Wooldridge asked Hawthorn to break twenty acres of prairie sod for which Wooldridge would pay him $50. Wooldridge also asked Hawthorn to break eighteen acres of prairie sod for which Wooldridge would allow Hawthorn to use the land for as long as necessary to raise wheat or corn. Wooldridge failed both to pay him and to allow him to use the land. Hawthorn sued Wooldridge in an action of assumpsit to recover the debt and requested $100 in damages. Wooldridge retained Stuart and Lincoln, pleaded not guilty, and requested a set-off of $314 because Hawthorn failed to pay him when Hawthorn was a tenant. The parties reached an agreement, and the court dismissed the case.
