- Handwritten affidavit, 17 x 21 cm, signed with his mark by Levi Summers and sworn to and subscribed by Thomas Moffett, Jus. Peace. 'Levi Summers upon his Oath Deposed and Saith that he attended one day as a Witness at the instance on behalf of Jacob Bales the Defendant in the above case at the present term of the Court.' Docketed on verso. Jacob Bale failed to pay Pollard Simmons $80 on an account. Simmons sued Bale in the Justice of the Peace court to recover the debt but the jury found for Bale. Simmons appealed the judgment to the circuit court. The court subpoenaed Lincoln as a witness for Bale. The case was later dismissed.
